Please read these General Terms and Conditions of Purchase before using the website http://www.digitalome.com as well as the services offered by DO TECH ACCESORIES S.L.

The customer’s use of the services offered by the DIGITALOME online store implies, in all cases, acceptance of the General Terms and Conditions of Purchase in the version published by DIGITALOME at the time the purchase order is placed.

Therefore, customers are advised to read these General Terms and Conditions before making a purchase.Legal information and acceptance of the general terms and conditions of purchase.

1.2 Description.

Through these General Terms and Conditions of Purchase, DIGITALOME offers its users and visitors the opportunity to purchase telephone and computer accessories online, as well as to communicate with the user.

DIGITALOME may change the design, layout, and/or configuration of the Website at any time and without prior notice wwww.digitalome.com, as well as some or all of the services.

1.3 Acceptance of the specific terms and conditions of purchase.

Access to and use of DIGITALOME’s Online Store service imply that the Visitor and/or Registered User fully and unreservedly accepts all the terms and conditions set forth in these General Terms and Conditions of Purchase. These General Terms and Conditions of Purchase apply to the sale of all items that DIGITALOME sells through https://digitalome.com/, and are intended exclusively for individuals over the age of 18.

DIGITALOME reserves the right to cancel a customer's account if fraudulent, speculative, or bad-faith activities are detected in the use of this service.

Furthermore, DIGITALOME reserves the right at all times to unilaterally modify these General Terms and Conditions of Purchase applicable to its Online Store.

ONLINE PURCHASE PROCESS. 

2.1 Our products: How to find them?

DIGITALOME offers an online store featuring phone and computer accessories, organized by category, to make it easier for you to find what you're looking for.

From the home page, you can access all levels of product families using the button bar at the top, and on the inner pages, using the drop-down menu on the left-hand side.

You can also find products on DIGITALOME using the search bar; simply enter a keyword (such as the product name, features, or EAN) and click the search button.

All products have a detailed listing that includes a photo, the name, a description, and the price including taxes not  . The images on the website are for illustrative purposes only; please refer to the product description.

All prices shown are not final prices, as they do not include the Value Added Tax (VAT) applicable in Spain. VAT will be applied at the time of purchase, although the user will always have access to a detailed breakdown of the product price.

We will also provide information on the different shipping options and delivery times available.

We also provide reviews for each product, let you read reviews from other users, and even let you email the product to a friend if you think they might be interested.

The prices listed on the product pages are intended to encourage customers to place an order; therefore, if there is an error in the prices, DIGITALOME will notify the customer of this and will not process the order.

2.2 Shop at DIGITALOME.

You don't need to register in advance to shop at DIGITALOME. Simply select the products you want, then go to your Shopping Cart and complete the checkout process.

Once your order is complete, we will ask you to provide certain information, including personal data such as your contact information, shipping address, shipping method, and payment method. You must also expressly accept these General Terms and Conditions of Purchase by checking the corresponding box before processing your order.

In addition, under the LOG IN / SIGN UP section, you can create a user account on DIGITALOME; signing up will make it easier for you to access our website and make purchases in the future. As a registered customer, you’ll receive discounts, promotions, and exclusive sales via email, and you won’t have to enter your information in the contact form every time you shop on DIGITALOME.

To register as a user, enter your information in the REGISTER section and click the "Register" button. You will receive an email with your registration details. Once your account has been created, we will send an email to the address you provided with a discount code for your first purchase. Order confirmations will be sent to that address.

2.3 Product availability.

The selection of products offered through our online store is valid as long as the products are visible, subject to available stock. Since this is an e-commerce platform, stock levels are updated online; therefore, it is possible that stock may run out during the purchase process, in which case the transaction cannot be completed.

In the event of a stock shortage or temporary unavailability of an item, DIGITALOME will contact the Customer as soon as possible to notify them and provide a new delivery date; or, if it is not possible to fulfill the order, cancel it or offer an alternative product with similar features and price. In any case, a delay in delivery beyond the specified deadlines shall not entitle the Customer to claim any compensation.

2.4 How is the order processed?

When you click the "Process Order" button (after selecting the products and quantities), a secure connection is established via SSL, and you will be prompted to enter certain information in the following forms:

  • Contact Information.
  • Shipping address details, if they differ from the contact information you provided.
  • Shipping method.
  • Payment method.

Next, you'll need to complete your order, accept the terms and conditions, and submit your order.

2.5 Shipping and Delivery Costs.

Shipping and/or handling fees are not included in the price and will be displayed to the Customer before the purchase is completed.

We use Correos Express to ship your items. The shipping rates are:

  • €4.50 for orders under €150 (in mainland Spain, up to 5 kg)
  • Free shipping on orders over €150 (Mainland Spain, up to 5 kg)
  • €10 for orders weighing up to 5 kg in the Canary Islands and the Balearic Islands.

Under normal circumstances, delivery times are 24–48 hours from the time payment for the order is received. These timeframes are calculated based on business days—Monday through Friday—since DIGITALOME does not ship on holidays, Saturdays, or Sundays. The shipping times listed are approximate, and deliveries will be made by the specified carrier throughout the day.

The shipping cost will be shown in detail before you complete your order.

DIGITALOME is not liable for any delays in shipping caused by:

  • Incorrect or incomplete address.
  • Do not provide a contact phone number.
  • Transportation strikes.
  • Adverse weather conditions.

If the Customer does not notice any external damage to the package upon receipt but, upon opening it, observes damage caused by shipping, they must notify the shipping company within 24 hours to document the issue and contact DIGITALOME. Otherwise, it will be understood that the Product has been accepted as is.

Once this period has elapsed, the shipping company considers the shipped items to be in perfect condition and assumes no liability for any damage.

2.6 What payment methods can I use?

Payment will be made upon completion of the purchase process and is a prerequisite for finalizing the transaction. In any case, the payment method is selected during the purchase process on the corresponding screen. We accept the following payment methods:

  • Payment by credit or debit card. Through a secure SSL connection, you are connected to Redsys, so your banking information is transmitted directly and securely; DIGITALOME does not have access to this information nor does it store it.
  • Payment by bank transfer. You can find the account information in the drop-down menu. If you choose this payment method, please note that your order will be shipped once the bank confirms payment, which usually takes 24–48 hours. It may be shipped sooner if you send us proof of the transfer to administracion@digitalome.com

The Secure E-Commerce system relies on the card issuer (bank or savings bank) verifying the cardholder’s identity before authorizing an online payment. DIGITALOME uses a debit or credit card payment system provided by Redsys. Therefore, once you have selected the product you wish to purchase and entered your card number, a Redsys window will open that communicates with your bank or card issuer to request your identification.

Your card details and password are protected by this security system from the moment you enter them. Once verification is complete, Redsys notifies DIGITALOME that the purchase is being made by the cardholder, allowing the cardholder to complete the transaction. If verification is unsuccessful, Redsys notifies DIGITALOME so that appropriate action can be taken.

This payment method is processed immediately; as soon as the customer makes the payment, DIGITALOME receives it and begins processing the order (after verifying that the information is correct). Once the order has been processed, you will be provided with a tracking number so you can track its status.

This merchant agrees not to allow any transaction that is illegal, or that is deemed by the credit card brands or the acquiring bank to be capable of, or likely to, damage their goodwill or negatively impact them. The following activities are prohibited under the card brand programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, or Cardholder(s).

2.7 And if I didn't make the purchase myself, what can I do?

If you notice an unauthorized or fraudulent charge on the card used for your purchases, you should contact us and your bank immediately—via email or phone—as soon as possible so that we can take the necessary steps. In addition, your bank and/or payment card issuers may implement anti-fraud measures that result in the rejection of certain types of transactions.

DIGITALOME VOUCHERS AND DISCOUNT COUPONS. 

DIGITALOME reserves the right to issue gift certificates and/or promotional or discount coupons to users and visitors of Wwww.digitalome.com, as it deems appropriate.

To use these coupons and discount vouchers correctly, you must enter the code when placing your order; DIGITALOME will apply the discount before payment is confirmed.

Gift certificates or promotional vouchers may be limited to a single use; if so, this will be specified. Gift certificates or promotional vouchers are not redeemable for cash.

Discounts cannot be combined, unless otherwise stated. DIGITALOME may run limited-time promotions designed to award gift certificates to users who make a specific purchase, for use on future purchases at Wwww.digitalome.com and within the gift certificate’s validity period. Outside of this validity period, the gift certificate becomes invalid.

RETURNS AND COMPLAINTS. 

The Customer may modify an order provided that it has not yet been shipped. If, for any reason, the Customer wishes to make a change to the order confirmation, they must notify us as soon as possible by emailing administracion@digitalome.com and specifying the desired changes. Any difference in amount between the original order and the modified order will be processed according to the procedure corresponding to the chosen payment method. Return and reshipment costs will not be covered by DIGITALOME.

DIGITALOME may not substitute a product ordered by the Customer without first consulting the Customer. If, for reasons beyond DIGITALOME’s control, the order cannot be fulfilled, the Customer will be offered the option of exchanging it for a substitute product with similar characteristics, or may choose to cancel the order.

If the Customer cancels a confirmed order after it has already left DIGITALOME’s facilities en route to its destination, or refuses to accept the package upon arrival, DIGITALOME may require payment of the shipping costs incurred as a result of the cancellation. All product returns that meet the following requirements will be accepted: The products must retain their original seal intact. Products without the seal will not be accepted for return, unless they have manufacturing defects, in which case they will be exchanged for identical items.

The customer is responsible for shipping costs in the event of a return, which must be paid directly to the shipping company at the time of pickup. The item to be returned must be properly packaged for return. Grounds for return include: The product does not match the description listed on our website. In this case, the product price will be refunded, excluding shipping costs. This refund will be issued to the payment method used by the customer via refund. The product is defective upon receipt. In this case, we will exchange it for an identical item once the returned product has been received. DIGITALOME will cover the shipping costs for both the return and the reshipment.

RIGHT OF WITHDRAWAL. 

In accordance with Royal Legislative Decree 1/2007, the Consolidated Text of the General Law for the Protection of Consumers and Users, DIGITALOME recognizes the right to cancel any purchase made on wwww.digitalome.com within 14 calendar days from the date the Customer received the product. To do so, the Customer must send an email to administracion@digitalome.com and return the goods without undue delay, within 14 calendar days from the date on which they communicate their decision to withdraw from the contract. The deadline will be considered met if the Customer returns the goods before the end of that period, sending them to:

With regard to withdrawal costs, this right shall not entail any cost to the consumer; however, if the return is due solely to the right of withdrawal and not to a lack of conformity of the product, the consumer shall bear the cost of returning the product. (Art. 108 of the Consolidated Text of the General Law for the Protection of Consumers and Users, TRLGDCU).

Therefore, the Customer must bear the direct cost of returning the goods. In all cases, the products being returned must be in perfect condition, in their original packaging, and include any manuals, accessories, or promotional gifts, if applicable. If this is not the case, the right of withdrawal cannot be exercised. The Returns Department will verify that everything is correct and in perfect condition, provide authorization to the Administration Department, and notify the Customer via email.

5.1 Products not subject to the right of withdrawal.

In accordance with Article 103 of Royal Legislative Decree 1/2007, dated November 16, which approves the Consolidated Text of the General Law for the Protection of Consumers and Users and other complementary laws, the right of withdrawal may not be exercised in relation to:

“The right of withdrawal doesnotapply to contracts relating to:

(a) The supply of goods made to the consumer’s or user’s specifications or clearly personalized.

(b) The supply of goods that are liable to deteriorate or expire rapidly.

c) “The supply of sealed goods that cannot be returned for reasons of health protection or hygiene and that have been unsealed after delivery.”

In accordance with current regulations, we do not accept returns of food products such as infant formula, baby food, dietary supplements, etc., as we can no longer ensure their quality. For hygiene reasons, we do not accept returns of face masks of any kind.

PRODUCT WARRANTY. 

The warranty period for products is three years from the date of delivery; however, this warranty does not cover defects caused by negligence, impact, misuse, improper handling, incorrect voltage, improper installation, or materials that have worn out due to use. Products subject to wear and tear, such as cases and batteries, are also not covered by the warranty. This warranty is provided by both DIGITALOME and the product’s manufacturers and, where applicable, authorized distributors.

The warranty provided by DIGITALOME will be void under the following circumstances:

  • Shocks and/or improper handling.
  • Tampering with any seal or identification/control label.
  • Normal wear and tear.

RMA WARRANTIES

 DEFECTIVE MATERIAL

To return defective items, please set aside any defective items in a box. For DIGITALOMEto cover the return shipping costs, you must have accumulated at least 4 or 5 defective items or a total value of more than €30.

When you have 4 or 5 items, or a total amount exceeding €30, that you wish to return due to a defect, please send a list via email to administración@digitalome.com, with the subject line “RMA PROCESSING” and detailing the defective items and exactly what is wrong with each one.

We will send our shipping company to the store to pick up the merchandise, and we will cover the shipping costs. Once we receive it, we will automatically replace it or issue a credit for your next order.

CUSTOMER RESPONSIBILITY.

The customer agrees to use the Services lawfully, without violating applicable laws or infringing upon the rights and interests of third parties.

The customer warrants the truthfulness and accuracy of the information provided when completing the contract forms, and agrees not to cause any harm to DIGITALOME as a result of any inaccuracies in such information.

You also agree to facilitate the delivery of the order by providing a delivery address where the order can be received during standard delivery hours (Monday through Friday from 9:00 AM to 2:00 PM and from 4:00 PM to 7:00 PM).

Failure to comply with any of these General Terms and Conditions may result in the cancellation of orders by DIGITALOME without prior notice to the customer and without entitling the customer to any compensation. If the customer refuses delivery, DIGITALOME will not refund the shipping costs, which shall be borne by the customer.

PERSONAL INFORMATION AND MARKETING COMMUNICATIONS.

We would like to remind you that DO TECH ACCESSORIES S.L. complies with current data protection regulations. In accordance with Organic Law 3/2018 of December 5 and the EU General Data Protection Regulation (GDPR) 679/2016, we are providing you with information regarding our processing of personal data.

We have organizational and technical measures in place to protect your personal data from loss, misuse, unauthorized access or disclosure, alteration, and/or destruction. Unfortunately, it is not possible to completely guarantee the security of any data transmission or storage system. INDUSTRIAL AND INTELLECTUAL PROPERTY. 

The intellectual and industrial property rights to the works, trademarks, logos, and any other protectable content on the website belong exclusively to DO TECH ACCESSORIES S.L., unless otherwise indicated. The unauthorized reproduction, distribution, commercialization, or modification of such works, trademarks, logos, etc., constitutes an infringement of the intellectual and industrial property rights of DO TECH ACCESSORIES S.L. or the owner thereof, and may give rise to the exercise of any judicial or extrajudicial actions that may be available to them in the exercise of their rights. Likewise, the information to which the customer may access through the website may be protected by industrial, intellectual, or other property rights. The Company shall not be liable under any circumstances for any infringements of such rights that you may commit as a user and/or customer.

NOTIFICATIONS. 

All notices, demands, requests, and other communications that must be made by the parties in connection with these General Terms and Conditions of Purchase must be made in writing and shall be deemed to have been duly delivered by regular mail to the other party’s address or via email. NULLITY AND INEFFECTIVENESS OF CLAUSES. 

If any provision of these General Terms and Conditions of Purchase is declared, in whole or in part, null and void or unenforceable, such nullity or unenforceability shall affect only that provision or the part thereof that is null and void or unenforceable, and the remainder of the General Terms and Conditions of Purchase shall remain in full force and effect. Consequently, the clause declared wholly or partially null and void or ineffective shall be deemed not to have been included. 

APPLICABLE LAW AND JURISDICTION. 

Sales transactions made on Wwww.digitalome.com are subject to Spanish law. In the event of any dispute arising from the interpretation of these general terms and conditions of purchase or from any actions resulting from the purchase process, the courts and tribunals with jurisdiction over the matter shall be those designated by the applicable legal regulations regarding competent jurisdiction. In the case of end consumers, the jurisdiction shall be determined, at the consumer’s choice, by the user’s place of residence or the place of performance of the obligation. In the event that the purchasing party acts on behalf of a legal entity, both parties hereby submit to the jurisdiction of the courts and tribunals of Madrid, expressly waiving any other jurisdiction.
